Terms and Conditions of Sale
1.2 Our trading name is CAF Cycling Apparel and our legal name is T L Simms trading as CAF Cycling Apparel. We are a sole trader business established in England and Wales. Our principal place of business is at 44 Napier Drive, Bolton BL6 6FZ.
1.3 You can contact us by email at: email@example.com. All email enquiries will be responded to as quickly as possible within our opening hours of Monday to Saturday 10 am – 3 pm. Alternatively, you can contact us by telephone on 07969847501 during opening hours.
1.4 If we need to contact you we will do so by telephone or by writing to you at the email address or postal address you have provided to us in your order.
1.5 All contracts with us will be deemed to have been made in England and you agree that the courts of England and Wales will have exclusive jurisdiction to determine any disputes.
2 ORDERS PLACED ON OUR WEBSITE
2.1 When you place your order at the end of the online checkout process (eg when you click on the 'Purchase' button), we will acknowledge it by email. This acknowledgement does not, however, mean that your order has been accepted.
2.2 We might contact you to say that we are unable accept your order. This is typically because the items you have ordered are unavailable or we haven't been able to authorise your payment. We will let you know the reason.
2.3 We will only accept your order when we email you to confirm this. At this point a legally binding contract will be in place between you and us.
2.4 If you wish to change your order once your order has been accepted then please contact us as soon as possible. It might be possible to change if we haven't posted your order to you yet. Otherwise, please refer to our Delivery and Returns Policy.
2.5 The prices quoted on our website are inclusive of VAT at the current rate and exclude delivery costs which are specified in our Delivery and Returns Policy.
2.6 The price, availability and specification of the items we sell are subject to change without notice before we accept your order but not after.
2.7 The images of the items on our website are for illustrative purposes only. Although we have made every effort to show the colours accurately, we cannot guarantee that your device's display of the colours accurately reflects the colour of the items. Your item may vary slightly from those images.
2.8 If you have purchased custom items from us then you are responsible for ensuring that the measurements provided are correct. If you require tips on how to measure then please contact us.
3 PAYMENT METHODS AND SECURITY
3.1 We accept either credit card or debit card payments via our secure payment system or payment using PayPal.
3.2 We will do all that we reasonably can to ensure that all of the information you give us when paying for your items is secure by using an encrypted secure payment system. However, in the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you provide to us.
4 OUR LIABILITY TO YOU
4.1 If we fail to comply with these Terms then we will only be responsible for loss or damage suffered by you that is a foreseeable result of our failure to comply or our failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.
4.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so.
